1. Acceptance of the Terms
You accept these Terms when you access the platform, create an account, click to accept, use free or paid features, submit content, generate AI materials, or continue using the platform after an update to the Terms.
These Terms form an agreement between you and Supernapse. Additional rules may be presented in specific areas of the application, purchase pages, support communications, fair use policies, paid plans, or app stores. In case of conflict, the specific rules for the corresponding functionality or transaction will prevail, provided they do not contradict mandatory legal rights.
The Privacy Policy, cookie notices, support policies, paid plan rules, and other policies published by Supernapse are incorporated into these Terms by reference.
By accepting these Terms, you also agree to receive electronic communications that are essential to the operation of the platform, as detailed in these Terms and in the Privacy Policy.
2. Eligibility and use by minors
The platform is intended for users who are at least 13 years old. People below this age must not create an account, access, or use Supernapse.
If you are between 13 and 17 years old, you must use the platform with the knowledge, authorization, and supervision of your parents or legal guardians when required by applicable law. By allowing use by a minor, the legal guardian agrees to these Terms and assumes responsibility for the account use, purchases made, content submitted, and guidance of the minor regarding safe use of the platform.
Supernapse may implement age verification, consent, parental supervision, feature restriction, or other proportional mechanisms to protect minor users and comply with legal obligations.
If we identify that an account was created by a person below the minimum age, we may suspend or terminate the account and delete associated data, except for legal retention obligations and measures necessary to protect the user.
Parents or guardians who have questions about use of the platform by minors may contact us at the email address indicated at the end of these Terms.
3. Description of the services
Supernapse offers a digital platform to support studying, organization of materials, review, and active learning, including artificial intelligence-based features.
Features may include, depending on the available version: upload or insertion of PDFs, documents, images, texts, links, and study materials; automatic creation of summaries, flashcards, quizzes, questions, and reviews; AI teacher or chat; content organization; progress tracking; export of materials; reminders and spaced review; and other related educational resources.
Supernapse is an auxiliary tool. The platform does not replace teachers, educational institutions, pedagogical guidance, professional advice, legal, medical, psychological, financial, or any specialized evaluation.
Supernapse does not guarantee exam approval, any specific performance increase, perfect memorization, absolute correctness of answers, availability of external content, or suitability of any material for a public notice, course, subject, or assessment.
We may change, update, add, remove, limit, suspend, or discontinue features, including AI resources, for technical, commercial, legal, security, provider availability, product improvement, or abuse prevention reasons.
4. Registration, account, and security
To access certain features, you must create an account and provide true, complete, and up-to-date information.
You are responsible for maintaining the confidentiality of your credentials, devices, access codes, and authentication methods, as well as for all activities carried out in your account.
You must not share your account with third parties, sell access, allow use by unauthorized persons, create fake accounts, use a third party identity, or bypass plan, age, security, or fair use limitations.
If you suspect unauthorized access, misuse, or a security flaw involving your account, notify Supernapse through the contact channel indicated in these Terms.
Supernapse may require a password reset, additional authentication, email confirmation, session termination, or other security measures when there is risk, suspected fraud, violation of these Terms, or operational need.
You are responsible for keeping your email address updated and accessible, as this is the main communication channel between you and Supernapse for account and service matters.
5. License to use the platform
Subject to compliance with these Terms, Supernapse grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the platform only for lawful, educational, personal, or other purposes authorized by Supernapse.
The platform is licensed, not sold. Nothing in these Terms transfers to you any rights over software, source code, models, trademarks, design, databases, technology, documentation, flows, interfaces, algorithms, internal prompts, proprietary tools, or other Supernapse assets.
You may not copy, modify, distribute, sell, rent, sublicense, commercially exploit, reverse engineer, decompile, attempt to extract source code, bypass protections, automate unauthorized access, or use the platform to improperly create a competing product.
6. Acceptable use of the platform
You agree to use Supernapse lawfully, ethically, safely, in accordance with these Terms, and respecting third-party rights, academic rules, policies of integrated providers, and applicable law.
It is prohibited to use the platform for: illegal, fraudulent, or deceptive activities; violation of copyrights, trademarks, image rights, privacy, or confidentiality; plagiarism, false authorship, improper circumvention of assessments, or other conduct contrary to the rules of educational institutions; harassment, intimidation, discrimination, hate speech, or exploitation of people; improper exposure of children or adolescents; deliberate creation or dissemination of disinformation; sending malware, spam, phishing, or content that compromises systems; scraping, bots, automation, attacks, overload, or exploitation of vulnerabilities without authorization; bypassing limits, filters, age restrictions, security mechanisms, or fair use rules; and any use that may harm Supernapse, users, third parties, or the integrity of the service.
It is also prohibited to use the platform to access, process, store, or share content that you do not have the right to use, including copyrighted materials, paid, restricted, confidential, or third-party terms-governed content without proper authorization.
Supernapse may apply technical limits, filters, moderation, blocks, suspension, account termination, content removal, AI use limitation, or other proportional measures in case of violation, abuse, security risk, or legal requirement.
7. User Content
“User Content” means any data, text, PDF, document, image, link, transcription, question, answer, note, exercise, academic material, file, prompt, command, comment, or other content that you insert, submit, import, upload, generate, store, or make available in Supernapse.
You retain ownership of the rights you already have over your User Content. Supernapse does not claim ownership of the materials you insert or export.
By inserting User Content, you represent that you have the necessary rights, licenses, permissions, or legal bases to use that content on the platform and allow it to be processed by Supernapse and by essential service providers.
You grant Supernapse a limited, non-exclusive, worldwide, free, and sublicensable license only to operators, providers, and technical partners necessary to host, store, process, transform, summarize, analyze, index, display, synchronize, back up, protect, export, generate answers, generate flashcards, generate quizzes, correct failures, provide support, prevent abuse, and execute the features requested by you.
This license exists only to the extent necessary to operate, maintain, protect, and improve the platform experience, in accordance with these Terms and the Privacy Policy. It does not authorize Supernapse to sell your User Content as individual third-party content.
You should avoid inserting sensitive personal data, trade secrets, confidential information, third-party data without authorization, or materials whose disclosure or processing may violate law, contract, duty of confidentiality, or third-party rights.
Materials exported or downloaded by you may be used by you, subject to these Terms, third-party rights, and any legal or academic restrictions applicable to the original content.
8. Content generated by artificial intelligence
Supernapse may use artificial intelligence models to generate summaries, flashcards, quizzes, explanations, answers, review suggestions, study organization, and other materials from content inserted by you or commands provided in the application.
AI-generated content may contain errors, omissions, inaccuracies, outdated information, inadequate interpretations, or answers that appear correct but are not. You must critically review all content before using it in studies, assignments, assessments, decisions, or publications.
Generated answers and materials are provided for educational and informational support. They do not constitute professional advice, official evaluation, academic guarantee, or specialized medical, psychological, legal, financial, or technical guidance.
Due to the nature of AI systems, identical or similar answers may be generated for different users. Supernapse does not guarantee exclusivity, absolute originality, absence of similarity, absence of bias, or full suitability for any particular objective.
You are responsible for verifying facts, sources, calculations, citations, dates, translations, academic answers, and any information generated or organized by the platform.
Supernapse may limit, filter, refuse, modify, or block AI requests when there is risk of legal violation, abuse, inappropriate content, academic fraud, security, protection of minors, excessive use, technical unavailability, or contractual obligation with AI providers.
9. Third-party services, external AI, and external content
The platform may depend on external providers, including, as applicable, artificial intelligence services, authentication, analytics, storage, hosting, infrastructure, payment processing, app stores, cloud services, support tools, and content platforms.
These services may include providers such as OpenAI, Google, Firebase, Amazon Web Services, Apple, Google Play, YouTube, or other equivalent suppliers, according to Supernapse current technical architecture.
When using AI features, prompts, texts, files, images, questions, and other content inserted by you may be sent to external providers for processing, response, moderation, security, or execution of the requested functionality, as described in the Privacy Policy.
Supernapse may replace, add, or remove third-party providers without prior notice, provided the purpose of the service is maintained and applicable legal obligations are observed.
Third-party content, links, and materials, including videos, pages, documents, educational platforms, and materials hosted outside Supernapse, are the responsibility of their respective owners. Supernapse does not control or guarantee the availability, legality, quality, continuity, accuracy, licensing, or policies of those third parties.
When you insert YouTube links or links from other platforms, you must respect the terms, policies, copyrights, access restrictions, and usage rules applicable to the content and source platform. Supernapse is not affiliated with, sponsored, or endorsed by those platforms unless expressly stated otherwise.
It is not permitted to use Supernapse to bypass paywalls, DRM, access restrictions, technical limitations, geographic blocks, third-party terms of use, or content owner rights.
10. Privacy, personal data, and security
The processing of personal data by Supernapse is governed by the Privacy Policy, which explains which data may be collected, for which purposes, on which legal bases, for how long it is retained, with whom it may be shared, and which rights the data subject may exercise.
Supernapse adopts reasonable technical and administrative measures to protect data and content against unauthorized access, loss, alteration, improper disclosure, or destruction. However, no system is absolutely secure or immune to failures.
You agree not to insert sensitive personal data, data of children or adolescents, third-party data, confidential information, or regulated content into the platform without need, authorization, and an appropriate legal basis.
When processing data of underage users, Supernapse will seek to observe the best interests of children and adolescents, comprehensive protection, transparency, data minimization, and proportional security and privacy measures.
Account or content deletion may result in permanent removal of associated data and materials, except in cases where retention is necessary to comply with legal obligations, security, fraud prevention, regular exercise of rights, dispute resolution, or other bases provided in the Privacy Policy.
11. Intellectual property
Supernapse, its trademarks, trade names, logos, layout, design, features, software, code, interfaces, databases, flows, internal prompts, documentation, institutional texts, proprietary materials, and other elements of the platform are protected by intellectual property rights and belong to Supernapse or its licensors.
You do not acquire any right over the platform beyond the limited use license provided in these Terms.
Comments, suggestions, ideas, feature requests, or feedback sent by you may be used by Supernapse to develop, correct, improve, or promote its products, without any obligation of compensation, provided they are not treated as confidential information under a specific written agreement.
If you believe that any content on the platform violates your copyright, trademark, image, or other rights, contact us with sufficient information for review, including identification of the content, proof of ownership or authorization, and return contact details.
12. Plans, subscriptions, payments, cancellation, and refunds
Certain features may be free, paid, limited by plan, subject to subscription, credits, usage limits, trial periods, promotional offers, or recurring charges.
Before purchase, Supernapse or the applicable payment platform will inform, as applicable, price, currency, taxes, billing period, automatic renewal, included features, usage limits, free trial conditions, cancellation method, and other material offer information.
Subscriptions may renew automatically until they are canceled. If there is a free or promotional period, it may convert into a paid subscription at the end of the informed period unless canceled within the applicable deadline.
Purchases made through the App Store, Google Play, or another intermediary are also subject to the terms, billing rules, cancellation, subscription management, and refund rules of those platforms. In general, cancellation must be made directly through the store or intermediary where the purchase was made.
Deleting the Supernapse account does not automatically cancel subscriptions contracted through app stores or payment intermediaries. You must cancel the subscription in the channel where the purchase was made.
When permitted by the store, intermediary, and applicable law, cancellation may end future renewal while maintaining access until the end of the already paid period. Refunds, reversals, or returns will follow the policies of the store or intermediary, without prejudice to mandatory consumer rights provided by law.
Supernapse may change prices, plans, limits, and features with appropriate notice. Price changes to active subscriptions will observe the rules of the payment platform and applicable law.
We may suspend or limit access to paid features in case of payment failure, improper chargeback, suspected fraud, plan abuse, violation of these Terms, or subscription termination.
Supernapse may send electronic communications related to payments, charges, renewals, payment failures, and subscription status.
13. Availability, support, and service changes
Supernapse will seek to keep the platform available and functional, but does not guarantee uninterrupted operation, absence of errors, failures, delays, losses, unavailability, AI limitations, or problems arising from third parties, internet, devices, app stores, cloud providers, or maintenance.
Interruptions may occur due to scheduled or emergency maintenance, updates, security incidents, technical failures, provider unavailability, capacity limitations, legal requirements, or reasons beyond Supernapse reasonable control.
Supernapse may launch experimental, beta, or test features, which may be modified, suspended, or removed at any time and may present instability.
Support will be provided through the channels indicated by Supernapse, subject to operational availability, the nature of the request, and the contracted plan, where applicable.
14. Suspension, account termination, and content removal
You may close your account at any time through the means made available on the platform or by requesting support, without prejudice to the need to separately cancel subscriptions contracted through stores or intermediaries.
Supernapse may suspend, limit, or terminate accounts, remove content, block features, restrict AI use, or prevent new purchases when there is: violation of these Terms; security risk; fraud; abusive use; default; improper chargeback; use by a person below the minimum age; violation of third-party rights; legal order; risk to children or adolescents; use that may harm users, third parties, or the platform; or need to protect the integrity of the service.
When reasonable and permitted, Supernapse may communicate the reason for the measure and offer a channel for clarification. In situations of risk, fraud, legal obligation, recurrence, or need to prevent harm, the measure may occur without prior notice.
Termination does not eliminate obligations already established, nor does it prevent retention of data strictly necessary for legal compliance, security, fraud prevention, regular exercise of rights, or dispute resolution.
15. Limitations of liability
To the fullest extent permitted by applicable law, Supernapse will not be liable for indirect, incidental, special damages, lost profits, loss of opportunity, loss of data caused by factors outside its reasonable control, temporary interruptions, third-party unavailability, decisions made based exclusively on AI-generated content, misuse of the account by the user, or violation of these Terms by users or third parties.
Supernapse is not responsible for content inserted by the user, third-party materials, external content, academic or professional decisions of the user, nor for specific study, memorization, grade, approval, or performance results.
Nothing in these Terms limits rights that cannot be waived by law, nor excludes liability for willful misconduct, gross negligence, mandatory legal obligation, consumer rights, data protection, or other cases in which limitation is prohibited.
Where limitation of liability is permitted by law, Supernapse total liability to the user will be limited to the amount effectively paid by the user to Supernapse in the 12 months preceding the event that gave rise to the claim, or to another mandatory minimum limit provided by law, if applicable.
16. Indemnification and reimbursement
Where permitted by applicable law, you agree to indemnify and reimburse Supernapse, its administrators, employees, contractors, licensors, and partners for direct losses, reasonable costs, claims, liabilities, and expenses arising from: content inserted by you; violation of these Terms; violation of third-party rights; illegal, fraudulent, or abusive use of the platform; dispute over ownership or authorization of submitted materials; or non-compliance with laws, academic rules, or third-party terms.
Supernapse will notify the user of relevant claims when reasonable and permitted, and may assume the defense or necessary cooperation to protect its rights.
17. Changes to these Terms
Supernapse may update these Terms periodically to reflect service changes, legal changes, app store requirements, new providers, security practices, commercial plans, or clarity improvements.
The most recent version will be available on the website, in the application, or through another official Supernapse channel. Relevant changes may be communicated by notice on the platform, email, notification, or other reasonable means.
Continued use of the platform after publication or entry into force of the new version constitutes acceptance of the updated Terms. If you do not agree, you must stop using the platform and, if applicable, cancel your subscription.
18. Compliance with App Store, Google Play, and other stores
When Supernapse is downloaded, accessed, or purchased through the Apple App Store, Google Play, or another app store, use will also be subject to the terms, policies, and rules of those stores.
Apple, Google, and other stores are not responsible for the platform, its content, support, maintenance, warranties, user claims, AI operation, generated materials, or Supernapse service, except where the store rules themselves provide otherwise.
For versions distributed by Apple, these Terms are entered into between you and Supernapse, not Apple. The use license is limited, non-transferable, and allows use of the application on Apple devices that you own or control, in accordance with Apple Media Services rules and applicable permissions, including family sharing or volume purchases when permitted.
You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms in relation to the iOS application and may enforce these Terms against you as third-party beneficiaries, as applicable.
You must comply with applicable third-party terms when using the platform, including connection terms, app store terms, payment provider terms, authentication, YouTube, cloud services, and AI provider terms.
19. Applicable law and venue
These Terms are governed by the laws of the Federative Republic of Brazil, without prejudice to mandatory rights of consumers, data subjects, or users protected by applicable local laws.
Where there is a consumer relationship, the user may exercise rights and access the competent venue as provided by consumer protection law, including the venue of their domicile where applicable.
Supernapse will seek to resolve questions, complaints, and disputes amicably through the contact channel indicated in these Terms before formal measures, whenever possible.
20. General provisions
Any tolerance by Supernapse regarding non-compliance with any clause will not constitute waiver, novation, or amendment of these Terms.
If any provision of these Terms is considered invalid, illegal, or unenforceable, the remaining provisions will remain valid and effective to the maximum extent permitted.
You may not transfer your rights or obligations under these Terms without Supernapse authorization. Supernapse may transfer these Terms in case of corporate reorganization, merger, acquisition, sale of assets, business succession, or equivalent transaction, subject to applicable law.
These Terms constitute the entire agreement between you and Supernapse regarding use of the platform, replacing prior understandings on the same subject.
In case of divergence between translated versions, the Brazilian Portuguese version will prevail, unless mandatory local law determines other treatment.
21. Contact
In case of questions, requests, complaints, content reports, account, privacy, payment, or Terms-related matters, contact Supernapse by email at: suporte@supernapse.app.
